Yes. It is important to understand that a legal operations function can open up a new way to purchase and even provide legal services that were not available to the profession until recently. This, coupled with the need for legal departments to become true business units of the company and not just “corporate-affiliated law firms,” will lead to further changes in the future. The operational function can help change the way the legal profession works in a very good way, which not only saves money, but also changes the way law is practiced – all for the better. In the context of invoicing, we have recently increased the use of material-by-material tenders. We hope to incorporate other fee arrangements, including a creative auction process, in the future. We hope that progressive or project-based billing can replace the need for some billable hour policies. Of course, this is something the industry has been trying to do for some time to move away from the billable hour. Personally, I am among those who believe that the end of the billable hour will be preferable in favor of researching and implementing value-based cost structures for buyers and legal service providers, and especially for lawyers who now charge by the hour. At the same time, we looked at all the data we had collected over several years as a corporate legal department – some we had used, some we hadn`t. We have ensured that our data is new and relevant, and will remain so by really tightening our case management system. In addition to Walmart`s business, cultural and legal services training, Walmart Ready offered participants the opportunity to meet with case managers in small, informal breakout sessions.
During these breakout sessions, case managers discussed the areas they needed it, honest advice on how they like to do their job, and details on how their service works. It seems that this kind of effort can bring real value to a legal department. Bryan and his colleagues developed Walmart Ready, an onboarding program for women and various external consultants from across the country. Now in its third year, the program takes place at Walmart`s headquarters in Bentonville, Arkansas. In 2016, Walmart invited approximately 100 shortlisted women and various external consultants to a day of training on its legal business, culture and operations, as well as breakout sessions. Walmart Ready was effective from the outset and attracted at least 25% of participants with new responsibilities or increased representation from Walmart within a year of participating. CCBJ: How did your role evolve at Walmart and how did you end up in legal and managing outside lawyers? The benefits of Walmart Ready go both ways: in-house lawyers can hire diverse, pre-screened external consultants trained in the company`s business, cultural and legal departments, and outside lawyers can market themselves and, if selected, be better positioned to serve Walmart.
